El objetivo de este artículo es abordar el reciente problema del nexo entre realismo y fenomenología hermenéutica desde un enfoque específico: el diálogo entre el nuevo realismo de Markus Gabriel y algunas propuestas hermenéutico-fenomenológicas alemanas que se autocomprenden en términos realistas. Afirmo la hipótesis de que es posible un diálogo productivo entre estas propuestas, basado en una comprensión mínima del realismo como fundamentación ontológica viable. Para esto, en primer lugar mostraré el sentido del actual resurgimiento del realismo en el (...) contexto de la ontología continental contemporánea, situando su recepción, crítica e integración a propósito del ámbito de la fenomenología y hermenéutica recientes. En segundo lugar, analizaré la propuesta de nuevo realismo, que está implicada en la ontología de campos de sentido de M. Gabriel. Y, en tercer lugar, reseñaré las propuestas de Günter Figal, Anton Friedrich Koch y Tobias Keiling en su fundamento realista. Mediante este trabajo comparativo, concluiré afirmando que el diálogo entre ambas corrientes comparte una comprensión realista no reductiva a la cuestión del mundo exterior, que le permite entenderlo como búsqueda de cierto criterio de objetividad para lo que aparece sensiblemente con sentido, con el propósito de esclarecer por qué las cosas reales son dependientes de la interpretación (interpretables en general), pero independientes de interpretaciones individuales. This article is part of the period of methodological expansion, proposed by the philosopher Arturo Roig (1922-2012), in the 70's and 80's. Although the analysis of categories is rooted in the philosophical field, this expansion is made in the direction of social categories. More specifically to the categories of “civilization” and “barbarism”, both in the field of the history of ideas and in the philosophical history of Latin American liberation. First, we give different definitions and their multiple uses of category (...) in philosophy. Subsequently, we analyze the category of “human dignity”, one of the arms of the very broad anthropological a priori category, systematized by the thinker from Mendoza. Then we disaggregate the proposal of a categorical rearmament, which has among its multiple functions: the rescue, criticism, replacement, reworking and integration of categories that have been forgotten, distorted, dehistoricized and decontextualized. The categories of “civilization” and “barbarism” have generated a semantic ordering of the discursive universe in Latin America. We review different theses proposed by Roig, in the historicization of the assessment -both negative and positive- of the category “barbarism” that different thinkers in Latin America have expressed. Among them: Juan Montalvo, Domingo Faustino Sarmiento, José Hernández, Juan Bautista Alberdi, Ezequiel Martínez Estrada, among the main ones. (shrink)

The European Commission produces the European Core Health Indicators, a database containing different tools used to compare European Union countries and recommend policy changes. The ECHI feeds multiple reports and documents and finds its way into health policies. From this arises the main research question addressed in this paper: How is health in Europe influenced by ECHI data practices? Specifically, we look at how some health issues or populations are prioritized or dismissed, which ultimately shapes the meaning of and knowledge (...) about health in Europe. To do so, we first develop the conceptual framework of “data performativity,” underlining how data practices shape their object/subject. We then explore the politics of evidence behind the ECHI health data that materialize into the absence of some health issues and populations and the hypervisibility of neoliberal health. In the end, we argue, the ECHI serves as a site of individual, collective, and political identity enunciation. (shrink)

Multiple studies show that periodic reanalysis of genomic test results held by clinical laboratories delivers significant increases in overall diagnostic yield. However, while there is a widespread consensus that implementing routine reanalysis procedures is highly desirable, there is an equally widespread understanding that routine reanalysis of individual patient results is not presently feasible to perform for all patients. Instead, researchers, geneticists and ethicists are beginning to turn their attention to one part of reanalysis—reinterpretation of previously classified variants—as a means of (...) achieving similar ends to large-scale individual reanalysis but in a more sustainable manner. This has led some to ask whether the responsible implementation of genomics in healthcare requires that diagnostic laboratories routinely reinterpret their genomic variant classifications and reissue patient reports in the case of materially relevant changes. In this paper, we set out the nature and scope of any such obligation, and analyse some of the main ethical considerations pertaining to a putative duty to reinterpret. We discern and assess three potential outcomes of reinterpretation—upgrades, downgrades and regrades—in light of ongoing duties of care, systemic error risks and diagnostic equity. We argue against the existence of any general duty to reinterpret genomic variant classifications, yet we contend that a suitably restricted duty to reinterpret ought to be recognised, and that the responsible implementation of genomics into healthcare must take this into account. We appreciate the opportunity to respond to Schneiderman and colleagues’ opinions on the recent Multiorganization Policy Statement, “An Official ATS/AACN/ACCP/ESICM/SCCM Policy Statement: Responding to Requests for Potentially Inappropriate Treatments in Intensive Care Units”. We will first point out three areas in which Schneiderman and colleagues seem to perceive a disagreement where there is none, then we will respond to their main criticisms of the Multiorganization Policy Statement. The objective of the text is to propose an interpretation of Hume's works that allows another way of refusing contractualism, different from the "official" refusal, and which is based (the new one) on the concept of artifice, which is extremely different from the artifice created by the contractualists, whose opposition the tradition of commentators of Humean political philosophy, generally, do not refer to, when it is the case of refusing contractualism.

An elementary embedding [Formula: see text] between two inner models of [Formula: see text] is cardinal preserving if [Formula: see text] and [Formula: see text] correctly compute the class of cardinals. We look at the case [Formula: see text] and show that there is no nontrivial cardinal preserving elementary embedding from [Formula: see text] into [Formula: see text], answering a question of Caicedo.

How much personal partiality do agent-centred prerogatives allow? If there are limits on what morality may demand of us, then how much does it permit? For a view Henry Shue has termed ‘yuppie ethics’, the answer to both questions is a great deal. It holds that rich people are morally permitted to spend large amounts of money on themselves, even when this means leaving those living in extreme poverty unaided. Against this view, I demonstrate that personal permissions are limited in (...) certain ways: their strength must be continuous with the reasons put forward to explain their presence inside morality to begin with. Typically, these reasons include non-alienation and the preservation of personal integrity. However, when personal costs do not result in alienation or violate integrity, they are things that morality can routinely demand of us. Yuppie ethics therefore runs afoul of what I call the ‘continuity constraint’. (shrink)

This article is a libertarian critique of incest laws. On the basis of the libertarian “harm principle”, one must ask what exactly is the harm that incest brings forth. Traditionally, anthropologists have tried to rationalize the incest taboo in various theories, and lawmakers have used these principles as grounds for the criminalization of incest. These principles are the preservation of family structure, the enhancement of alliances and the avoidance of genetic risks. While I acknowledge that these rationalizations are plausible, I (...) argue that they are still not sufficient grounds for the preservation of incest laws, and consequently, there is an ethical need to reform them. As it has historically been the case with many pandemics, the Covid-19 experience will induce many philosophers to reconsider the value of medical practice. This should be a good opportunity to critically scrutinize the way medical research and medical interventions are carried out. For much of its history, medicine has been very inefficient. But, even in its contemporary forms, a review of common protocols in medical research and medical interventions reveal many shortcomings, especially related to methodological flaws, and more importantly, (...) conflicts of interests due to profit incentives. In the face of these problems, we propose a program of “gentle medicine”. This term, originally formulated by philosopher Jacob Stegenga, describes a form of medicine in which physicians intervene less than they currently do. As part of this general program, we advance a series of reform recommendations that could be enacted both by medical staff in their everyday practice, but also by public health officials and policymakers. Ethical issues at the workplace have once again become topical and important due to considerable adverse publicity surrounding reports of unethical business practices by corporate managers. Accordingly, this paper re-visits the question of whether gender, age and work experience do have an effect on ethical judgement, using 655 business students as respondents. This is necessary as business students are likely to become managers during their career and will face complex ethical concerns and dilemmas in their daily, routine affairs. The findings (...) currently demonstrate that females are more ethically aware than their male counterparts – that is, there are differences between males and females regarding ethical judgement. There is also evidence to suggest that age is a factor that does impact on ethical judgement. However, we also found evidence to suggest that in some cases, the age factor does not necessarily have a significant impact on ethical awareness. The results further indicate that there is a difference in ethical judgement related to work experience. However, at the same time, in one question there is no evidence to suggest the claim that work experience does impact significantly on ethical judgement. Overall, it appears that ethical awareness does increase alongside work experience. (shrink)

Identity is a modally inflexible relation: two objects are necessarily identical or necessarily distinct. However, identity is not alone in this respect. We will look at the relation that one object bears to some objects if and only if it is one of them. In particular, we will consider the credentials of the thesis that no matter what some objects are, an object is necessarily one of them or necessarily not one of them.

Do mereological fusions have their parts necessarily? None of the axioms of non-modal formulations of classical mereology appear to speak directly to this question. And yet a great many philosophers who take the part-whole relation to be governed by classical mereology seem to assume that they do. In addition to this, many philosophers who make allowance for the part-whole relation to obtain merely contingently between a part and a mereological fusion tend to depart from non-modal formulations of classical mereology at (...) least when it comes to the axiom of Unique Fusion, which states that no two different mereological fusions ever fuse exactly the same objects. This is no coincidence. There are reasons of principle why one’s adherence to classical mereology should exert some pull towards the view that mereological fusions have their parts necessarily. There is, however, no direct route from the combination of classical mereology and propositional modal logic to the hypothesis that the part-whole relation obtains necessarily between a part and a mereological fusion. In order to bridge between a modal formulation of classical mereology and the hypothesis that fusions have their parts necessarily, one needs to strengthen the axiom of Unrestricted Fusion in a way that is agreeable to many philosophers on both sides of the debate. « Rites » sont d'abord de séquences d'actions corporelles définies socialement plus ou moins strictement. Très souvent, mais pas toujours les sociétés attendent qu'aux actes extérieurs correspondent des motivations, des croyances et des émotions intérieures ou « psychiques ». Il ya des sociétés où l'efficacité supposée des rites dépend de la correspondance entre mouvements corporels et «réalité » intérieure. Mais il y en a d'autres où ce qui compte c'est uniquement l'exécution minutieuse des gestes corporels en tant que tels. De (...) toute façon, des actions rituelles ne sauraient être interprétées comme suivant exclusivement un calcul rationnel, bien qu'un observateur sociologique pourrait constater une fonction objectivement positive d'un rite sur le plan social ou psychique sans qu'il y ait une relation causale sur le plan physique. C'est surtout dans le cas des rites de deuil où on observe que des actions objectivement ineffectives, donc symboliques, « répondent » à une situation qui ne peut être altérée sur le plan « réel », mais qui aident à supporter l'insupportable. On constate quand même la possibilité que ce qui n'était d'abord qu'un mouvement extérieur s'imprègne de valeurs symboliques, comme si par exemple une douleur rituellement infligée devient le symbôle de l'appartenance à un groupe social. Les rites sont donc l'incarnation du social dans les corps des sujets. Ils s'y inscrivent. Surtout dans les grandes civilisations les rites deviennent un système administré par des spécialistes, qui développent un « code élaboré » qui n'est déchiffrable que par les experts. L'article montre qu'il ya une certaine opposition entre contrôle rituel et moral de comportements humains."Rites" are first sequences bodily actions socially defined more or less strictly. Very often, but not always expect companies as external acts are the motivations, beliefs and inner emotions or "psychic". There are societies where the supposed efficacy of rites depends on the correspondence between body movements and "reality" inside. But there are others where what counts is only the meticulous execution of bodily gestures as such. Anyway, ritual actions can not be interpreted exclusively as following a rational calculation, although a sociological observer could see a positive function objectively a rite of social or psychic without a causal relationship to the physical plane. It is especially in the case of mourning rites which we observe that actions objectively ineffective, so symbolic, "respond" to a situation that can not be altered on the "real", but help to bear the unbearable. There is still the possibility that what was at first a movement outside soaks symbolic values, such as if ritually inflicted pain becomes the symbol of belonging to a social group. The rites are the incarnation of social issues in the body. They enroll. Especially in the great civilizations rituals are a system administered by specialists who develop "elaborated code" that is decipherable only by experts. The article shows that there is a tension between moral and ritual control of human behavior. (shrink)

El Estado de Hegel es el Estado de Derecho. Sin embargo en su Filosofía del Derecho se encuentran fundamentos decisivos para una teoría del Estado Social. Siguiendo el hilo de las Líneas fundamentales de la Filosofía del Derecho, se empieza por ver el derecho al bienestar, tal como se formula en la Moralidad (1). En la familia aparece el derecho de los hijos "de ser alimentados y educados" (2). El Derecho al bienestar se concreta en la sociedad civil (3), se (...) hace posible en el sistema de las necesidades (3.1.) y efectivo en la policía y la corporación (3.2 y 3.3), que ejercen funciones de suplencia de la familia. El mayor problema es la pobreza, tanto la que surge por contingencias subjetivas y sociales como por el funcionamiento mismo de la sociedad civil: la plebe. A este problema la sociedad es incapaz de darle una solución. (shrink)

This paper explores several topics related to Woodin’s HOD conjecture. We improve the large cardinal hypothesis of Woodin’s HOD dichotomy theorem from an extendible cardinal to a strongly compact cardinal. We show that assuming there is a strongly compact cardinal and the HOD hypothesis holds, there is no elementary embedding from HOD to HOD, settling a question of Woodin. We show that the HOD hypothesis is equivalent to a uniqueness property of elementary embeddings of levels of the cumulative hierarchy. We (...) prove that the HOD hypothesis holds if and only if every regular cardinal above the first strongly compact cardinal carries an ordinal definable [Formula: see text]-Jónsson algebra. We show that if the HOD hypothesis holds and HOD satisfies the Ultrapower Axiom, then every supercompact cardinal is supercompact in HOD. (shrink)

This paper examines Jacques Derrida's analysis of Walter Benjamin's ‘Critique of Violence’ in the context of their respective theories of the university. Whereas Derrida foregrounds the complex ways that the university and law are intertwined, Benjamin claims that the ‘educative power’ stands removed from the law by identifying the university with ‘divine violence’. ‘Force of Law’ not only questions the possibility of a neutral, pre-legal space that Benjamin's theory warrants, ‘Force of Law’ also draws attention to the laws structuring the (...) colloquia that gave rise to Derrida's text. This paper claims that Derrida's analysis of justice, law, violence, and justesse is thus informed by a theory of the university, and that the ways in which Derrida's theory of law stands opposed to Benjamin's parallels the ways in which Derrida's theory of the university questions Benjamin's understanding of the ‘educative power’. This paper concludes by drawing attention to the demand posed by the absence of justice in the academy. Although the laws of the academy produce justesse in the present, this negatively affirms justice in the future, which cannot wait. (shrink)

In confessing the bold words, “I believe in the resurrection of the body,” we Christians affirm that the corruptibilities that everywhere loom so large will not have the last word. To the contrary, resurrection—both Christ's and ours—is the hope by which we live and the light by which we see.

Despite progress, discrimination in public health remains a problem. A significant aspect of this problem relates to how medical resources are allocated. The paradigm of quality-adjusted-life-year (QALY) dictates that medical resources should be allocated on the basis of units measured as length of life and quality of life that are expected after the implementation of a treatment. In this article, I discuss some of the ethical shortcomings of QALY, by focusing on some of its flawed moral aspects, as well as (...) the way it relates to discrimination on the basis of age, race, and disability status. I argue that while this approach seeks to maximize efficiency, it does not place sufficient value on the preservation of life itself. Even more concerning is the fact that the use of QALY disproportionately harms minorities. While QALY is a well-intentioned approach to the allocation of scarce healthcare resources, new alternatives must be sought. (shrink)

El presente trabajo se propone subrayar la relevancia filosófica del amor acudiendo al desarrollo analítico que del mismo realiza Harry G. Frankfurt. Para ello nos valdremos de la categorización que establece Bennett Helm y encuadraremos la teoría de Frankfurt dentro de una categoría concreta: la del amor como «gran preocupación» [«robust concern»]. Esto nos servirá para atender a la psicología moral de dicho autor y al peso decisivo que el amor juega en la misma; revestido aquel, como afirma Frankfurt, de (...) una autoridad tal que dota de sentido último a nuestro razonamiento práctico. Finalmente, y expuesta la relevancia del amor dentro de todo este proceso, se procederá a discutir de la mano de Jonathan Lear si el amor posee la autoridad que Frankfurt le asigna. (shrink)

The popular notion of bullshit and the term that expresses it has received little philosophical attention despite the fact that it pervades much of human discourse. Frankfurt recovered bullshit analysis in the eighties and opened the way to studies on its nature and function. Our interest in bullshit is philosophically analytical, but also practical, as bullshit particularly affects the field of science policy. In order to understand that double character, we first present Grice’s model of meaning of expressions and then (...) summarize the controversy between the tobacco industry and the US Administration, which allows us to state our basic hypothesis: tobacco companies have developed and implemented a discursive tactic of bullshit in order to delay or avoid governmental regulations and decisions. Before eventually applying the Gricean model to various cases of bullshit, we locate our approach against the background of the comparison between sound and junk science. In this paper we show that first-order languages extended with partially ordered connectives and partially ordered quantifiers define, under a certain interpretation, their own truth-predicate. The interpretation in question is in terms of games of imperfect information. This result is compared with those of Kripke and Feferman.

Although recent trends in politics and media make it appear that conspiracy theories are on the rise, in fact they have always been present, probably because they are sustained by natural dispositions of the human brain. This is also the case with medical conspiracy theories. This article reviews some of the most notorious health-related conspiracy theories. It then approaches the reasons why people believe these theories, using concepts from cognitive science. On the basis of that knowledge, the article makes normative (...) proposals for public health officials and health workers as a whole, to deal with conspiracy theories, in order to preserve some of the fundamental principles of medical ethics. A finalidade explícita na arquitetura e ênfase na utilidade, no aspecto de uma aplicação prática, intrigou filósofos alemães como Immanuel Kant e August Schlegel. O entrelaçamento entre beleza e finalidade na arquitetura fora notado cedo por Marco Vitrúvio Polião, que aponta utilidade, solidez e beleza como características fundamentais da obra arquitetônica. Segundo Guyer, a partir de Kant, o pensamento filosófico sobre a arquitetura começa a apresentar um distanciamento em relação a Vitrúvio, de modo que, mesmo sem total renúncia à tríade (...) vitruviana no pensamento de Kant, este defende ser a característica principal da arquitetura representar ideias estéticas. A tese de Guyer aponta o desenvolvimento desse ponto de Kant em Schelling, Hegel e Schopenhauer, todavia com uma lacuna: August Schlegel, fundador do primeiro sistema de belas artes com sua Kunstlehre. Buscaremos aprofundar como a tese de Guyer não só é válida, mas ganha mais solidez no caso de August Schlegel e do papel que este confere à imaginação na arquitetura. Após a indicação de elementos vitruvianos e pós-vitruvianos em Kant e Schlegel, indicaremos as divergências entre ambos na apreciação da arquitetura, a partir de suas articulações entre arquitetura e finalidade. Achille Mbembe’s latest book addresses some of the existential concerns of the modern age and the power structures that have shaped them. Modernity’s allure has created a false belief in the idea of progress while concealing a destructive streak in human activities. He warns that there is trouble ahead unless humans chart a different course. But is this the lamentation of a Jeremiad or a timely intervention in the current state of the world?

Abordaremos como a ‘fé racional pura’ de Kant surge no contexto da ligação necessária entre moralidade e felicidade (o conceito kantiano de sumo Bem). Em seguida, abordaremos a recepção deste filósofo por Feuerbach, que ora se serve de Kant, ora o critica, principalmente pela redução da religião à moralidade promovida pelo filósofo de Königsberg – haja vista que Feuerbach enfatiza o papel do sentimento na fé. Finalmente, confrontaremos Feuerbach com Kant, tentando observar qual é a sede da fé para cada (...) autor: a razão pura e sua demanda de integração necessária da moralidade com a felicidade (Kant) ou o temor diante das forças da natureza somado ao desejo de imortalidade (Feuerbach). O que buscamos demonstrar é como, a nosso ver, tanto a razão quanto a afetividade estão em jogo na fé. A questão é a compreensão acerca de qual nível de consciência e de qual faculdade do ânimo se considera o ser humano. Busca-se também, ao longo da exposição, refletir sobre como Kant, ainda que tenha buscado fundar uma moral a priorística, acabou inserindo nela vários elementos históricos e contingentes, como fica nítido pela a influência do Cristianismo. Modern philosophy is based on the presupposition of the certainty of the ego’s experience. Both Descartes and Kant assume this certitude as the basis for certain knowledge. Here the argument is developed that this ego has its sources not only in Scholastic philosophy, but also in the narrative of the emotional self as developed by both the troubadours and the medieval mystics. This narrative self has three moments: salvation, self-irony, and nostalgia. While salvation is rooted in the Christian tradition, self-irony (...) and nostalgia are first addressed in twelfth-century troubadour poetry in Occitania. Their integration into a narrative self was developed in late medieval mysticism, and reached its fullest articulation in St. Teresa of Avila, whom Descartes read. (shrink)

The Igbo knowledge system articulated by Amaechi Udefi is insufficient to ensure knowledge progress as opposed to the system found in fallibilism theory. The reason is that there is a level of intellectual openness fallibilism theory guarantees that is not found in Udefi’s thought. This paper aims to do a comparative study of fallibilism theory and Udefi’s account of the Igbo knowledge system. The study also investigates to what extent each knowledge system can ensure knowledge growth and development. The significance (...) of this study is to highlight the importance of knowledge progress in the overall development of society. This paper argues that even though Udefi and Popper were reasoning from different cultural environments, Popper’s falsifiability theory is more open to knowledge progress than Udefi’s Igbo knowledge system. This article aims to propose a critical and exploratory survey of utopian narratives published in Chile from 1829 to 1934 employing a qualitative and diachronic approach. The fundamental objective of this study is to make evident the thematic tendencies, formal recurrences, influences, and key differences in utopian works of fiction written over a century of Chilean history, connecting these with the overall development of Chilean society, in such a way as to express how the utopian narratives of this period reflect, (...) critique, or rebel against the hegemonic social projects present in the country. Last, this article also seeks to approach these works from the distinctive point of view of the field of utopian studies, thus establishing the relevance of its theoretical framework in the analysis of Chilean fiction. We show from an abstract comparison principle that the Mitchell order is linear on sufficiently strong ultrafilters: normal ultrafilters, Dodd solid ultrafilters, and assuming GCH, generalized normal ultrafilters. This gives a conditional answer to the well-known question of whether a [Formula: see text]-supercompact cardinal [Formula: see text] must carry more than one normal measure of order 0. Conditioned on a very plausible iteration hypothesis, the answer is no, since the Ultrapower Axiom holds in the canonical inner models at the finite (...) levels of supercompactness. (shrink)

I examine two explanatory models of choking: the representationalist model and the anti-representationalist model. The representationalist model is based largely on Anderson's ACT model of procedural knowledge and is developed by Masters, Beilock and Carr. The antirepresentationalist model is based on dynamical models of cognition and embodied action and is developed by Dreyfus who employs an antirepresentational view of know-how. I identify the models' similarities and differences. I then suggest that Dreyfus is wrong to believe representational activity requires reflection and (...) attention. I also argue that the representationalist model of choking is preferable, since some embodied actions require appeals to representations, something not available to Dreyfus's anti-representational model.
